On a quiet afternoon in Muthitha village, Murang'a county, the kind where nothing more urgent than farm work breaks the rhythm of the day, a family dispute spiralled into irreversible tragedy.
It began not with a weapon, but with fists and by evening, one man lay dead, and another had set in motion a chain of events that would end in prison years later.
On October 5, 2020, at 2:30 pm Peter Mau walked into the home compound of his nephew, Joseph Mburu Wanyoike. He found Wanyoike’s mother and brother outside.
According to court records, "for no good reason,” Mau launched a sudden and violent attack on Wanyoike's brother and began assaulting him, striking his head with blows.
When the boy’s mother intervened and tried to shield her son from the attack, she too was beaten. Mau picked up a piece of wood and struck her, causing serious injuries to her head.
Fearing for her life, bleeding and shaken, the mother fled and reported the incident at Ngurweini Police Post.
When Wanyoike returned home and learned what had happened, he did not go to the police. The 30-year-old man did not wait for elders or Nyumba Kumi members to mediate. He did not pause long enough for anger to cool. It was deeply personal.
He went looking for his uncle, eager to know why his mother had been attacked.
The court would later describe his reaction as one driven by rage — understandable, perhaps, but unlawful.
Justice Cecilia Githua, in her ruling, described the case as “quite tragic,” warning of “the irredeemable loss and damage uncontrolled emotions and anger can cause to disputants and their families if personal conflicts are not resolved amicably or through due process.”
When Wanyoike confronted Mau, the exchange quickly escalated into a physical confrontation. In a moment that lasted seconds but would echo for years, Wanyoike stabbed Mau in the stomach.
The wound proved fatal since an autopsy would later conclude that Mau died from shock caused by massive bleeding. Mau never made it to the hospital alive; he was pronounced dead on arrival.
In that instant, a son who may have believed he was defending his family became a man who had taken a life.
After the stabbing, Wanyoike disappeared from home and the village. He remained underground and evaded arrest for three years.
Behind him, two closely related families were left to reckon with the aftermath: one mourning a husband and breadwinner, the other carrying the weight of what their son had done. The two men lived in neighbouring compounds.
He was eventually arrested in July 2023 and charged with murder. The charge was later reduced to manslaughter after he entered into a plea bargain agreement dated April 25, 2025.
It was a legal compromise, one that spared him the uncertainty of a full murder trial and acknowledged that the killing happened in the heat of the moment.
By admitting responsibility, he avoided a full court trial. But the court still had to determine the appropriate sentence.
In mitigation, his lawyers urged the court to show leniency. They said he was 30 years old, a first offender, and remorseful.
They also told the court that he had reconciled with the victim’s family. His lawyers argued that the accused had been in custody since July 2023, and the period spent in custody should be considered sufficient punishment for the offence he committed.
According to Justice Githua, the report gave “a distinct impression that the accused was not remorseful for the offence he committed.”
It also did not support claims of reconciliation. The victim’s family, the report noted, remained bitter, still grappling with the loss of a husband and father who had been their sole breadwinner.
The report also cast doubt on claims of remorse, leaving the judge unconvinced that reconciliation had truly taken place.
In delivering her ruling, Justice Githua acknowledged the circumstances that led to the fatal encounter. She noted that Mau’s assault on the accused’s mother and brother was unlawful and “understandably evoked anger.”
There were other options, the judge said. The law offered channels for redress. Violence did not have to answer violence. Instead, it had ended a life.
"The accused should have sought to resolve the matter amicably or have it addressed through the normal legal mechanism instead of resorting to violence,” the judge said.
The court found that the response was disproportionate and unlawful, leading to a needless loss of life.
“Mau needlessly lost his life,” the court observed.
Manslaughter, the court emphasised, is a serious offence carrying a maximum sentence of life imprisonment.
Even so, the court considered both mitigating and aggravating factors. The court took into account the plea bargain, noting that it had saved the court’s time.
But the lack of demonstrated remorse and the unresolved grief of the victim’s family weighed heavily.
In the end, the court rejected the request for a non-custodial sentence.
“I find that a custodial sentence is most appropriate in this case,” Justice Githua ruled.
The court sentenced Wanyoike to 10 years in prison, backdated to August 2023 when he was first arraigned.
It was, in the judge’s view, a balance after recognition of the plea bargain and the time already served, weighed against the seriousness of taking a life.
