The government has marked 2,802 non-governmental bodies, including the Sakaja Foundation linked to Nairobi Governor Johnson Sakaja, for de-registration after breaching terms and conditions attached to their certificates.
In a gazette notice dated December 5, the Public Benefit Organisations Regulatory Authority (PBORA) said the move will take effect fifteen days from the date the notice was issued.
“The authority intends to cancel the registration certificates of the organisations listed in the schedule hereto on grounds that they have breached the provisions of the Act and violated the terms and conditions attached to their certificates,” read the notice.
The Sakaja Foundation is listed as one of several that has defaulted for a period of one year. Others are Chameria Children Support Centre, Ambassador Daniel Kazungu Foundation, Biofill Foundation, Borabu Initiative, Citizenry Against Poverty among others.
De-registration of the NGOs follows operationalisation of the Public Benefits Organisations (PBOs) Act in May 2024. The law provides for the registration, regulation and management of NGOs in Kenya.
Under the law, every NGO which had been registered under the repealed law is deemed to be registered as a PBO under the new law.
They were also required to apply for registration under the Act three months after the new law commenced.
Mr Lindon Nicolas Otieno, the Acting Director General of Public Benefits Regulatory Authority said the NGOs failed file their returns.
“This is an ongoing exercise that we always do. Most of these organizations have failed to file their returns as required by law. We have given them a notice so that they can adhere within that time frame. If they fail, we will proceed to issue them a notice of cancellation of their licenses,” Mr Otieno said.
