Eldoret court hands 40 year-jail term to man who raped 6-year-old

Man sentenced to 40 years in jail after defiling 6-year-old girl

A court in Eldoret has sentenced a 24-year-old man to 40 years in jail fter he was found guilty of defiling a six-year-old girl.

Peter Nyongesa appeared before the Eldoret Senior Principal Magistrate Mogire Onkoba on Thursday, where the court found him guilty following four years of prosecution.

The prosecution told the court that Mr Nyongesa committed the offence on December 4, 2020, at Kimumu on the outskirts of Eldoret town in a maize plantation between 5 and 6pm, contrary to Section 8(1) of the Sexual Offences Act No.3 of 2006.

The court heard that the accused, who is an acquaintance of the minor, secluded her in the middle of a maize plantation where he sexually assaulted her.

After committing the offence, he left the victim in pain before she was rescued by a passer-by who took her to her mother.

The victim told her mother what happened, after which she was taken to a local hospital where an examination confirmed that she was defiled.

Mr Nyongesa was arrested on December 5, 2020, by police officers from Ainabtich police station in Moiben Sub-County.

“Due to overwhelming evidence presented in this court by the prosecution, this court has found out that the accused took advantage of an innocent six-year-old girl. To deter like-minded people, the offender is sentenced to 40 years in prison,” ruled Mr Onkoba. 

The convict has 14 days to appeal the sentence.

KDF soldier accused on incest

In a separate case, a Kenya Defence Forces (KDF) soldier from Trans-Nzoia County was arraigned before the Kitale Law Courts over incest charges.

The soldier serving in Isiolo is accused of defiling his 14-year-old daughter, a Form One student, at different times between 2015 and 2024, whenever he came home for leave.

He appeared before Principal Magistrate Caroline Njalale to take a plea after he was arrested at his home in Kiungani, Kiminini Sub-County, on October 25.  

He pleaded not guilty to the charges.

The court heard that his daughter, a boarding school student, refused to go home after the school closed for the third term. When pressed for answers, she revealed that she feared being sexually assaulted by her father, leading to the soldier's arrest when he arrived home from his work.

The Principal magistrate ordered that he be released on a bond of Sh500,000 or surety of the same amount. The case will be mentioned on November 20 for pre-trial.

The prosecution has lined up four witnesses to testify on the matter.
