Civil society group back Koome, top judges’ fight against JSC

The Katiba Institute has filed papers in the High Court in support of Supreme Court judges' challenge to the Judicial Service Commission's (JSC) disciplinary process, arguing that the JSC must adopt rules of procedure before proceeding.
The civil society group claims that the JSC's actions threaten the independence of the judiciary and the rule of law, and that judges may fear retaliation if they take adverse decisions against state organs.
The Judicial Service Commission (JSC) should not consider complaints against judges without first enacting the rules of procedure to govern disciplinary proceedings, a civil society group has told the High Court in an effort to stop the removal of Supreme Court justices.
At the same time, one of the petitioners wants the case filed by Chief Justice Martha Koome challenging her trial at the JSC Disciplinary Committee dismissed.
