The College of Insurance is on the verge of losing one of its plots of land in South C, Nairobi County, which has served as a sports ground for students over the years.
The college also hosts the Edge Hotel and Convention Centre where several meetings, including government functions, are held.
The Environment and Lands Court, under Case No 816 of 2012, had ruled that Mr Karume was the rightful owner of the contested land. However, the Insurance and Education Trust, which runs the college, protested the ruling and filed an appeal, which is still pending.
Despite this, construction works began on the ground after building materials were brought to the site under the protection of police officers from Akilla Police Post.
It is reported that the developer acquired an eviction order through a Miscellaneous Application on June 4, 2025.
According to an affidavit by the Director and Chief Executive Officer of the Insurance Training and Education Trust, Dr Ben Kajwang, the court had previously declared the Trust the lawful and valid owner of the land in a judgment issued on October 27, 2020.
Through TripleOKlaw LLP Advocates, the trust filed a certificate of urgency before the Environment and Lands Court at Milimani Law Courts seeking to stop the eviction.
“To forestall the illegal eviction of the applicant herein, the applicant filed a Notice of Motion Application dated October 16, 2024, which was certified by this Honourable Court on October 17, 2024. Directions were issued on filing submissions, which have since been filed. The application is pending a ruling before the court,” TripleOKlaw LLP stated in a letter dated May 5, 2025.
The institution urged the court to consider its application and determine the matter urgently in the interest of justice.
This development comes amid three other pending applications filed by Mr Ahmed seeking police assistance to evict the institution from the property.
Last Sunday, individuals alleged to have been hired stormed the institution and brought down one of the gates, allowing trucks carrying construction materials to access the land.
“The said auctioneer has today forcefully brought in hundreds of hooligans and attempted to illegally and unlawfully evict the Applicant from the suit property before the determination of the pending applications and the ruling of the Court of Appeal scheduled for delivery on June 20, 2025 in Civil Application SUP E015 of 2024, Insurance Training & Education Trust vs Joseph Ndung’u Gathondu and five others,” the advocate representing the institution stated.
According to one of the institution’s security officers, two individuals working at the Edge Convention Centre sustained injuries during the scuffle and were taken to the nearest medical facility for treatment.
“Our guests were terrified by the situation. We had to evacuate them and ensure their safety. The attackers were armed with arrows, some of which were recovered and taken by the Akilla OCS, who arrived later,” the officer told Nation.
The institution has filed a civil application seeking to overturn the Court of Appeal judgment that granted the private developer ownership of the land.
The ruling is scheduled to be delivered by the Court of Appeal on June 20, 2025.
