The Director of Public Prosecutions (DPP) is seeking a warrant of arrest against a senior official of East Africa Development Bank (EADB) over allegations of giving false information on a property dispute involving former Cabinet Secretary Raphael Tuju.
Mr Isaac Nyongesa Okwara is wanted by the State to face criminal charges of giving false information to police detectives at the Directorate of Criminal Investigations (DCI) on August 8, 2023.
He was expected to appear in court on Tuesday for plea-taking, but he failed prompting the State to apply for the warrant of arrest.
According to DPP, Mr Okwara is the chief security officer of the regional bank which was entangled in a legal dispute with Mr Tuju over sale of his Karen property following a debt of Sh4.5 billion arising from a botched loan deal. He was also one of the witnesses in the legal dispute.
Mr Okwara allegedly misled Police Inspector Duncan Maina by providing false details that led to the initiation of criminal investigations against Mr Tuju concerning alleged illegal transfer of a mortgaged property and making unlawful receipts.
Prosecutor James Gachoka on Tuesday told Milimani Principal Magistrate Dolphina Arego that summons had been issued to Mr Okwara.
But Mr Okwara's lawyer Fred Ojiambo informed the court that the suspect was in Uganda after leaving the country on January 23, 2025.
Lawyer Ojiambo said his client had also secured an order from the High Court suspending the intended prosecution pending determination of his petition. He urged the magistrate court to down its tools.
However, the prosecutor insisted that Mr Okwara knew he was wanted in court having been served with court summons to attend court.
The prosecutor urged that in absence of a copy of the order from the High Court suspending the trial, the magistrate should issue the warrant.
