Abdishakur Muse Mohammed and Yussuf Mohammed Yussuf were charged alongside engineer Daniel Alphonse Odhiambo and Gedion Chege Gakundi, alias Gideon Chege Mwangi.
Milimani Senior Principal Magistrate Pauline Mugo also summoned Fredrick Ondari Ochanda, a member of the Nairobi County Urban Planning and Technical Committee, to appear in court on July 27, 2026, to plead to charges of abuse of office.
Prosecuting counsel Hilary Isiaho told the court that the Director of Public Prosecutions (DPP) had approved charges against 10 suspects over the collapse of Mamzil Towers.
"The DPP approved the charging of 10 suspects over the collapse of the ill-fated building, which left two people dead," Mr Isiaho told the court.
However, the prosecutor said only four suspects had honoured police summonses to appear in court and answer the 17 criminal charges approved by the DPP.
Mr Isiaho said six of the 10 suspects failed to appear in court to answer the charges and applied for court summonses compelling them to attend proceedings on July 27, 2026.
Abdishakur, Yussuf, Daniel Odhiambo and Gedion Chege Gakundi were charged with manslaughter contrary to Section 202 as read with Section 205 of the Penal Code.
The court heard that on January 2, 2026, at South C in Lang'ata Sub-county, the four unlawfully caused the deaths of Ali Adan Galgalo Abdi and Hassan Huka.
Abdishakur and Yussuf were jointly charged with forging a notification of approval for application number PLUPA-BPM-002115-N, purporting to authorise a change of land use. The alleged approval document was dated March 23, 2023.
They also face a charge of fraudulently uploading the forged approval document to the National Construction Authority (NCA) online project registration system.
The DPP further alleges that the two forged a geotechnical investigation report dated February 24, 2021.
They are also accused of presenting the forged geotechnical investigation report to the NCA offices in Nairobi on November 4, 2023.
In another count, the two are accused of forging a Directorate of Occupational Safety and Health Services certificate of registration for a building or construction site on July 11, 2025.
They also face charges of forging an Environmental Impact Assessment (EIA) licence, registration number 6927232, dated March 17, 2023, and presenting it to the NCA while falsely claiming it had been issued by the National Environment Management Authority (Nema).
All four accused were also charged with commencing construction of Mamzil Towers on Land Reference No. 209/5909/10 (Nairobi Block 68/1306) in February 2024 without a valid Environmental Impact Assessment licence.

Akivaga's lawyers, Danstan Omari and Shadrack Wambui, told the court that their client was unavailable to take plea.
"Our client, Patrick Analo Akivaga, is not present in court to plead to the charges. He is out on police cash bail and we shall avail him at the appropriate time as he is seeking other reliefs at the High Court," Mr Omari said.
The four accused denied all the charges and applied to be released on bond. The prosecution did not oppose the application.
The magistrate directed that the case be mentioned on July 27, 2026, and ordered police to refund the cash bail previously paid by the accused during investigations.
