'Body By Design' case: Surgeon and clinic owners charged, to remain behind bars

A surgeon and the owner of "Body By Design" clinic, charged with killing a woman after plastic surgery gone wrong, will remain in custody for two weeks pending an impact pre-bail report on the victims affected.
Senior Principal Magistrate Samson Temu ordered that Dr Robert Maweu Mutula, Mr George Wakaria Njoroge and Ms Lilian Edna Wanjiru Mwariri of Omnicare Medical Ltd – or Body By Design – to remain behind bars until April 15.
The three deny killing Lucy Wambui Kamau on October 16, 2024. She died after undergoing a liposuction 360/BBL procedure.
The court said the prosecution and defence addressed the rights of the accused persons but failed to address the plight of the victims.
“Before this court can address the matter of bond for the accused, I direct the probation office to avail an impact report from the victims,” Mr Temu said.
The magistrate added that the victims include the widower, his children and other family members.
The court said the pre-bail report should also indicate if the clinic is still operational.
The Level 3B hospital, which is incorporated and registered with the Kenya Medical Practitioners and Dentists Board (KMPDC), is on Kabasiran Avenue, Nairobi.
Manslaughter
Dr Mutula, a surgeon attached to the Ministry of Defence, Mr Njoroge (the owner of Omnicare), Ms Mwairi and Omnicare have been charged with manslaughter.
The prosecution opposed their release on bond, saying investigations are yet to be finalised and that the three may interfere with witnesses.
The plea to deny them bond was opposed by defence lawyers Danstan Omari, Cliff Ombeta and Shadrack Wambui, who said the accused are not a flight risk as they are professionals plying their trade in Nairobi.
Mr Ombeta said the accused have cooperated with investigating officers and are willing to assist police in concluding the case.
