An IT graduate has been charged with alleged hacking and illegal sale of Nation Media Group (NMG) e-newspapers.

Antony Mwanzia Kimeu was arraigned at the Milimani Law Courts on March 2, 2026, where he faced two counts of sale and irregular distribution of infringed copies of the digital newspapers from NMG between June and July 2025.

He denied the two counts.

The graduate from the Jomo Kenyatta University of Agriculture and Technology, who is currently advancing his studies at the Open University of Kenya, is accused of hacking copyright e-newspapers of the Daily Nation, Taifa Leo, Business Daily and the East African.

His arraignmentfollowed the dropping of a copyright infringement case against two other men by the Director of Public Prosecutions Renson Ingonga. The two have since been converted into prosecution witnesses.

Jackson Wangigi Kariuki and Calvin Kinyanjui Kung’u had earlier been charged with distributing pirated editions of the publications via WhatsApp.

Mr Mwanzia was charged with copyright infringement of the digital newspapers and distributing the publications through his WhatsApp account that is linked to his registered phone number.

He allegedly distributed the hacked copies of the products without authority or consent of the Copyright Owner - the Nation Media Group PLC, where the copyright subsists in its name.

According to the charge sheet signed by the DPP, Mr Mwanzia is said to have committed the offence between June 23 and July 10, 2025 at an unknown place within the Republic of Kenya.

In the second count, Mr Mwanzia is charged with offering for sale copies of the publications through his WhatsApp social media link.

The accused applied to be released on bond, saying he was arrested last Friday (February 27, 2025) and detained in police custody. He was nabbed at his home in Machakos County.

He said he is not a flight risk, promising the trial magistrate Ms Teresa Nyagena to abide by the bond terms. The prosecuting counsel did not oppose the bail plea, saying it was a right of the accused persons.

In a brief ruling, the trial magistrate said bail is a fundamental and constitutional right of the accused. Mr Mwanzia was ordered to deposit a bond of Sh200,000 with a surety of the same amount.

The prosecution was directed to supply the accused with copies of the witness statements to enable him prepare his defence. The case will be mentioned in two weeks for pretrial directions.

The prosecution has lined up six witnesses to testify against the accused, among them Sam Koskei of NMG PLC.
