Judge orders release of abducted six, police to produce them in court tomorrow

The High Court has ordered the immediate and unconditional release of six youths abducted by persons suspected to be police officers.

The six are Peter Muteti, Bernard Kavuli, Billy Mwangi, Gideon Kibet, Rony Kiplangat and Steve Kivango.

Justice Bahati Mwamuye also directed Inspector-General of Police Douglas Kanja to produce the six youths in court on Tuesday.

"Produce the 2nd to 7th Petitioners/Applicants at Milimani Law Courts, High Court Wing, Nairobi City County on 31/12/2024 at 11am...or explain under oath the circumstances of the matter and the whereabouts of the Petitioners/Applicants in default of their production," the order by Justice Mwamuye said. 

He further ordered the Director-General of National Transport and Safety Authority (NTSA), Mr George Njao, or any other authorised officer to appear in court on January 3, 2025. This, he said, is to produce records with respect to the motor vehicles said to have been captured allegedly abducting the youths. 

In a habeas corpus application, Busia Senator Okiya Omtatah sought the production of the six youths who have been missing.

The legislator said the families of the missing persons have indicated that they have searched for them without success.

“I have also received information from the families of the applicants that they have visited a number of morgues in Nairobi and Kiambu and have not seen their bodies,” he said in the petition. 

Mr Omtatah pleaded with the court to release the six on bond or produce their bodies.

He said Mr Kibet went missing on December 25 from Kikuyu, and that the others disappeared on various dates.
