Okemo, Gichuru case to start afresh

The extradition case facing Nambale MP Chris Okemo and former Kenya Power boss Samuel Gichuru will now start afresh.

The High Court Tuesday ruled that special prosecutor Patrick Kiage was not validly appointed.

The two are fighting extradition to Jersey Island, where they are wanted for allegedly laundering Sh900 million. They also face fraud and abuse of office charges.

Last week, Mr Gichuru and Mr Okemo objected to Mr Kiage’s role following a ruling in Tinderet MP Henry Mr Kosgey's case.

Justice Nicholas Ombija ruled that the former Industrialisation minister was being prosecuted illegally by Mr Kiage whose contract had expired.

Justice Ombija granted Mr Kosgey the permission to initiate a judicial review of his prosecution and ordered that the case pending before an anti-corruption court should not proceed until his petition is heard and determined. (READ: Court halts suspended minister Kosgey's case)

Mr Okemo and Mr Gichuru have also accused the prosecution of delaying the case by not giving them crucial documents on time.
