Allowing the detention of the two, the magistrate said the police had presented cogent reasons to warrant the detention of Ms Angella Mulwa and Mr Nelson Masiga Makaralu.
The court observed that among the issues being probed by police in the killing of Dr Mutiso are invasion and demolition of her Sh1.5billion property and theft of high-end vehicles from the compound in Mlolongo, Athi River, Machakos County.
The detention of Ms Mulwa and Mr Makaralu brings to four those detained over the July 29, 2026 shooting of Dr Mutiso.
Others who have been detained include Rose Mbithe Mulwa, 75 and her son Chris Mulwa. Angella and Chris, both advocates of the High Court, are siblings.
Ms Mbithe was earlier married to renowned psychiatrist Prof David Musyimi Ndetei before they divorced in 2001 and he married Dr Mutiso.
“I have analyzed the evidence presented by the police and prosecuting counsel and find that they have presented reasonable grounds as the matter in question is of great public interest,” the magistrate ruled.
Defense lawyers Katunga Mbuvi, Danstan Omari and Cliff Ombeta had urged the court to release the duo on bond.
They alleged that police officers beat up Ms Angella during her arrest. Last Friday, she had teamed up with other lawyers to defend her mother in court.
The two suspects are being investigated for her murder and theft of title documents of a Sh1.5 billion 20-acre parcel of land in Mlolongo, Athi River, Machakos County.
The two will be held in police custody until August 18, 2026.
Crime detectives from the Athi River DCI Station are investigating the alleged land fraud which evolved into eviction, theft, demolition and destruction of property.
The vehicles include KDU 799Y (a Range Rover), KBT 935T (a Toyota Prado), KAK 225K (Toyota pick-up) and KAN 506B (Toyota Corolla).
Two of the vehicles were owned by AFRIMEB of Dr Mutiso while the other belonged to Prof David Ndetei.
Besides the fuel guzzlers, the court heard the two suspects are also being investigated for illegal invasion into the private property of the deceased.
The magistrate heard that the property in dispute had a long-running case at the High Court where Rose Mbithe Mulwa had sued Dr Mutiso.
“The families of the complainants have suffered irreparable loss involving unlawful eviction, demolition of their matrimonial properties all valued over Sh1.5 billion,” Sergeant Gilbert Okello told the court on Monday.
Sgt Okello is investigating alleged forgery of a High Court Order which paved the way for the invasion and eviction of Dr Mutiso from the property in Mlolongo.
Sgt Okello said police are studying CCTV videos recovered from the scene of the shooting to establish the occupants of a vehicle, which is alleged to have been at the scene of the doctor’s murder, to unmask the true killers.
The court also heard the KDU 799Y is the vehicle that blocked Dr Mutiso’s vehicle, a taxi KDJ 609D she had boarded en route to her workplace.
Sgt Mutiso said Ms Angella and Makaralu are being investigated for the offences of murder, forgery and property.
“They are likely to be culpable for other offences related to the property in contention and the murder charge,” submitted the prosecuting counsel.
