Cosmetic clinic Body by Design moves to court to challenge closure notice by KMPDC

Cosmetic clinic Omnicare, also known as Body by Design, has filed a court application challenging a closure notice issued by the Kenya Medical Practitioners and Dentists Council (KMPDC) for its Lavington facility.

The clinic has distanced itself from allegations of a botched cosmetic surgery linked to the death of businesswoman Lucy Wambui.

Omnicare's court application comes after the KMPDC ordered the closure of its Lavington facility. The clinic insists it is fully registered and in compliance with regulatory requirements.

According to lawyer Danstan Omari, who is representing the owners, the facility is well equipped with "state-of-the-art medical equipment and qualified surgeons".

The applicants say in court papers that Ms Wambui underwent a procedure and was due to be discharged on October 17, 2024. However, they allege, she requested a voluntary extension of her stay which was granted by the facility. 

The documents further state that she later complained of chest pains and was attended to by doctors and nurses at Omnicare then later discharged.

According to Body by Design, she left the facility on October 22, 2024.

The management further stated that Ms Wambui returned to the facility at 6pm but that it was already closed for the day, but assigned a doctor who followed her to Nairobi Hospital where she died while undergoing a second procedure on October 26, 2024.

Mr Omari now wants the court to issue an order quashing the closure notice posted at the entrance to the premises, which effectively suspended the facility's operations pending investigations.

The clinic argues that KMPDC's closure notice is unconstitutional, irrational and unreasonable, and seeks an order to prevent any disruption to its daily operations.
