Two land buyers have lost their bid to stop the distribution of a disputed family estate after the High Court ruled that they have no legal claim to property belonging to a deceased person's estate.
The court also found that the case was filed in the wrong court.
Justice Noel Adagi dismissed an application by Charles Owiti Agutu and Rosemary Atieno Tolo Owidhi, who claimed they bought one acre of land in Mavoko Town from members of the deceased's widow's family. He also ordered them to pay the estate administrators Sh30,000 in costs.
The pair had sought to be enjoined as interested parties in a succession case involving the estates of the late Beth Syokau Kinama and Joyce Nditi Kinama. They argued that they had bought the land, paid the agreed purchase price but had never been issued with title deeds.
They asked the court to preserve what they described as their interest in the land, saying the administrators could distribute the estate without taking their claim into account.
But the administrators, Rose Mwikali Mutie Mutinda, Ruth Wausi Mutua, Rose Nthenya Muange and Shadrack Kyalo, argued that the sale agreements were illegal because they were entered into by people who had no authority to sell estate property.
They also maintained that the buyers were not beneficiaries of the estates and that any dispute over ownership belonged before the Environment and Land Court, not a succession court.
“It is undisputed that the applicants allegedly bought a part of the deceased's property when the deceased had already passed on and before appointment of administrators of the deceased's estate,” he said.
“For that reason, the applicants have no legal claim on the deceased's estate and their actions already amount to intermeddling with a deceased's estate, which is a recognised criminal offence,” he ruled.
Justice Adagi said the buyers' remedy, if any, lay against the people who sold them the land.
“Accordingly, the applicants should allow the administrators to proceed and confirm the grant and thereafter they can pursue the beneficiaries who sold the deceased's land illegally for redress,” he said in a ruling delivered on July 16 2026.
The judge further held that the High Court, sitting as a succession court, had no jurisdiction to determine whether the disputed sale agreements were valid.
“It is not the mandate of this court to determine whether sales happened or whether sales were valid,” he said, adding that such disputes should be handled by the Environment and Land Court.
The court dismissed the application dated October 16, 2025, and awarded the estate administrators Sh30,000 in costs.
