Former Interior Cabinet Secretary, Fred Matiang’i has been summoned to the Directorate of Criminal Investigations headquarters tomorrow February 24, failure to which he will be liable for prosecution.
According to the summons issued by detective Michael K. Sang attached to the DCI’s Serous Crime Unit, Dr Matiang’i is to assist the State in its investigations against the former CS on allegations of false information contrary to Section 23 of the Computer Misuse and Cyber Crimes Act 2018.
The notice also adds that there are other offences concerning the alleged invasion and raid of Dr Matiang’i’s residence that supposedly happened from the night of February 8 to the early hours of February 9.
“I have reasons to believe that you, Dr Fred Matiang’i, the former Cabinet Secretary, Ministry of Interior and National Coordination, is connected to the offence or has information which can assist in my investigations,” the summons said.
This development comes two weeks after Dr Matiang’i, through his lawyer Danstan Omari and a brigade of politicians led by former Prime Minister Raila Odinga, claimed that the former Interior Cabinet Secretary’s house was being raided by a multi-agency team including the DCI and the Ethics and Anti-Corruption Commission.
The claims were refuted by the government’s security apparatus, led by Interior Cabinet Secretary Kithure Kindiki.
“There are procedures that govern how to summon, arrest, question and even prosecute someone in court. We do not just raid people’s houses at night. It turned out there was no raid and maybe the former CS was apprehensive. I can say without fear, no police officer went to the former CS’s residence,” CS Kindiki told the Nation in an interview on Monday.
“Everyone in office will at some point leave the office. I am careful not to use my time to try and hurt and treat people unfairly because I will be a former Minister at some point,” he added.
However, he added that the DCI was investigating the matter and would pursue it to its conclusive end.
Contacted over the summoning of his client, Mr Omari said he was still in touch with the former CS and was awaiting his directions on whether they should swiftly move to court to block the summons.
This comes on the same day that the court quashed the DCI’s move to summon Mr Omari over claims that the police raided Matiang’is home after Justice Ngaah allowed the lawyer to challenge the legality of the summons.
The High Court in Milimani Nairobi has also extended orders barring police from arresting Dr Matiang’i until April 19.
