The clothes a motor rally driver wore on the day she had a scuffle with her boyfriend who later died had no bloodstains, a court has heard.
Mr John Wambua, a crime scene detective, testified he did not find any blood stains on Ms Maxine Wahome’s clothes on December 12, 2022, when he inspected their house at Kileleshwa Preston Court.
Ms Maxine is charged with killing motor rally champion Assad Khan. She has denied the charge.
The senior police officer on Monday, March 3, told the High Court that he took 52 photographs of the scene on the fateful day.
“Maxine did not have any blood on her body or on her clothes when I found her at their house at Kileleshwa, Nairobi,” Mr Wambua told Justice Lilian Mutende as hearing of the murder trial resumed.
The court was told Assad injured himself when he kicked and broke a steel door glass pane.
Mr Wambua said he was directed to reconstruct the scene and take photographs of the house. He also went to Avenue Hospital where Assad died to photograph the body.
He told the trial judge he found blood on the floor and the staircase leading into the house.
Mr Wambua also testified that he found Ms Maxine seated at the balcony of their house with the door firmly closed.
“I found the accused (Maxine) seated at the balcony crying. Her clothes were not blood stained at all,” he responded to questions by Ms Maxine’s lawyers, Philip Murgor and Steven Kimathi.
He said Ms Maxine was on the outer side of the balcony and Assad had been taken to hospital.
The officer produced 52 photographs he took at the scene, including of the broken door pane, the house, Maxine’s clothes and the body of Assad.
“In the first instance police were investigating an offence of grievous arm but later the circumstances changed when Assad died while undergoing treatment at the Avenue Hospital, Nairobi,” Mr Wambua told the judge.
Maxine has denied she murdered Assad on December 12, 2022 after returning from an evening party.
The officer said from the investigations he carried out, it was evident that Assad injured himself when he kicked the door pane which cut his lower after it stuck in the broken glass.
“The lower part of the leg has veins and arteries which if cut may bleed and cause one to lose a lot of blood,” Mr Murgor asked Mr Wambua.
“Yes if one injures his lower limb there are many arteries and veins which bleed a lot,” Mr Wambua answered.
He said knives in the kitchen, a sharp metal and pen-knife he found at the living room were “very clean. They did not have any blood stains.”
The judge heard that when police arrived they found Maxine crying at the balcony but had no blood on her body nor on her clothes.
Mr Wambua identified Maxine to the judge as the woman he found at the balcony crying. He said from Kileleshwa he went to Avenue Hospital where he took photos of the deceased who had succumbed.
He also attended the postmortem that was conducted by a government Pathologist.
The court was further was told that last year all the doctors came to the conclusion Assad died from fungal and gram-negative bacterial Septicemia.
Maxine who has denied she murdered Assad is out on bond. The hearing continues.
