The prosecution has opposed Mr Hurley's participation, arguing that he was not involved in the recovery of the drugs.
The defence maintains that Mr Hurley’s role is neither to determine the law nor to recount what happened during the seizure.
The government is fighting to keep a former Scotland Yard detective out of the witness stand in the Sh8.2 billion methamphetamine case against six Iranians, arguing that his expertise cannot compensate for the fact that he was not involved in the seizure or investigation of the drugs.
The detective, Kevin Hurley, is among the witnesses lined up to challenge the prosecution’s case, with his evidence expected to focus on the procedures and safeguards that should govern the recovery, preservation, identification, transfer, sampling, analysis and presentation of suspected narcotic drugs seized during a maritime interdiction.
