Senators save Eric Mutai from impeachment, again

Kericho Governor Erick Mutai has survived an impeachment after 25 senators voted to terminate his impeachment, citing failure by the Assembly to meet the two-thirds threshold requirement.

Kisumu Senator Tom Ojienda said the moment there is doubt on the numbers that voted, then that doubt must be addressed in favour of the governor.

"We can't sacrifice the governor at the altar of an unverified system," Prof Ojienda said.

Uasin Gishu Senator Jackson Mandago also faulted the Assembly system, saying it was not possible to develop a system and immediately deploy it for usage without even doing a test run.

Vihiga Senator Godfrey Osotsi said the Assembly's electronic voting system that was deployed to impeach the governor was not consistent with Article 88 of the Constitution, which stipulates that any system of voting must be simple, accurate and verifiable.

However, Kericho Senator Aaron Cheruiyot warned that even if the governor survives, the people will find a way through other constitutional bodies mandated to fight corruption to get justice and accountability
