SHA fraud: DPP recommends charges against private hospital owners

Director of Public Prosecutions (DPP) Renson Ingonga has recommended the prosecution of more than 15 proprietors of private hospitals suspected of receiving millions of fraudulent payments from government insurer Social Health Authority (SHA).
Mr Ingonga said in a statement on February 25 that it had reviewed the files from the Directorate of Criminal Investigations (DCI) and recommended the prosecution of the proprietors for receiving millions fraudulently, from SHA.
“Upon review, the DPP has directed charges against the following persons and institutions,” the statement said.
The charges against the proprietors include conspiracy to defraud, operating unlicensed health facilities and obtaining money by false pretenses.
Also to face charges is Mr Harun Liluma, an employee of the Kenya Medical Practitioners and Dentist Council, who is accused of unauthorised access computer system and abuse of office.
Among those recommended to face charges are Mohammed Kulow Ali and Hassan Adan Ibrahim alleged to be directors of Danaba Care Hospital.
Operating unlicensed health facility
Other than conspiracy to defraud contrary, the DPP recommended charges of operating an unlicensed health facility contrary to the Medical Practitioners and Dentists Act, against them.
Kamsia Hassan Kala and Hawa Alinoor Malo, alleged to be former directors Kamishawa Medical Centre will be charged with obtaining money by false pretenses and conspiracy to defraud.
The proprietors of Kaafi Nursing Home Ibrahim Rashid and Ahmed Mohamud Adan will face several charges including obtaining money by false pretence and operating an unlicensed health facility.
Others recommended for prosecution are Naima Sheikh Ali, Abdihakim Sheikh Ali, Adan Abdikhaliq Abdullah, who are the proprietors of Mama Nerbeel Nursing Home, Ali Edin Ibrahim, the owner of Alati Nursing Home and Ismail Omar Mohammed, the proprietor of Julun Nursing Home.
The DPP also recommended the prosecution of directors of Adfaal Kids Care Medical Centre Mohamed Mohamud Sheikh, Ali Ahmed Adan and Mohamednoor Ismael Omar Kulow Ali and Hassan Adan Ibrahim.
Yussuf Siat Jelle, the director of Dimtu Nursing Home Limited is accused of fraudulent registration and receiving fraudulent payments.
