The government has suspended all mining operations at Tata Chemicals Magadi, accusing the soda ash producer of failing to comply with key provisions of the Mining Act and related regulations.
Mining Cabinet Secretary Hassan Ali Joho announced the suspension yesterday, saying the company would remain closed until it demonstrates full compliance with mining laws and settles outstanding regulatory obligations.
In a statement, Mr Joho said the decision followed years of engagement between the State Department for Mining and the company over its statutory obligations.
The ministry accused Tata Chemicals Magadi of failing to present a clear mineral beneficiation strategy in line with the government’s policy of promoting local processing before export.
It also cited unresolved royalty reconciliation, incomplete export reporting, inadequate implementation of Community Development Agreements, insufficient environmental compliance, limited employment and skills transfer programmes for Kenyans, and low procurement from local suppliers.

The company has been directed to submit documents demonstrating compliance and address all outstanding liabilities before operations can resume.

The suspension marks one of the toughest enforcement actions against a major mining company since Kenya strengthened oversight of the extractives sector.
The government has increasingly required miners to process minerals locally to boost manufacturing, create jobs and increase export earnings.
Tata Chemicals Magadi, Kenya’s only producer of natural soda ash, has operated at Lake Magadi for decades and is among the country’s largest mining employers and mineral exporters.
The company has previously been involved in legal disputes with Kajiado County over land rates and mineral royalties. Last year, the Court of Appeal ruled that mineral royalties belong to the national government under the Constitution and the Mining Act.
