The High Court in Kibera has ordered Kenyatta National Hospital (KNH) to release a long-delayed psychiatric assessment report of a suspect linked to the murder of a General Service Unit (GSU) officer at State House in Nairobi last year.

The court directed that the mental evaluation report of suspect Kithuka Kimunyi Musyimi be submitted within 14 days, warning that further delays would undermine justice and amount to unlawful detention.

Mr Musyimi was arrested in October 2025 over the death of Police Constable Ramadhan Khamisi Matanka. However, plea taking has been deferred four times because the psychiatric report has not been submitted to the court.

Mr Musyimi, who is also alleged to be a former worker at State House, was scheduled to take plea on Wednesday. But once again, that was postponed because of lack of a psychiatric report.

The suspect underwent an evaluation several weeks earlier, but KNH has not presented its findings in court. This is a requirement before plea-taking is done in a murder case.

The court postponed the plea taking to February 9, and ordered that the mental assessment report be submitted by then to determine if Mr Musyimi is fit to stand trial.

At the same time, Mr Musyimi was remanded at Nairobi Remand Prison. The prison authorities informed the court that they had sent multiple requests to KNH over the report but had not received a response.

“The hospital has delayed the mental assessment report despite numerous follow-ups,” a prison officer told the court.

In a stern ruling, the court said that the delay was unacceptable considering the suspect’s prolonged detention since his arrest last October.

“The court directs Kenyatta National Hospital and the Office of the Director of Public Prosecutions to ensure that the report is filed within two weeks,” the court ruled.

The case stems from a security breach at State House on October 14, 2025, which shocked the nation and raised serious concerns over presidential security.

The suspect was swiftly arrested after the fatal incident. Detectives requested the court for more time to trace possible accomplices, and also establish the motive behind the attack.

DCI investigations revealed that Mr Musyimi travelled from Makueni County to Nairobi on the night before the attack. At around 8.10am, he allegedly approached Gate D at State House along Dennis Pritt Road disguised as a mentally unstable street dweller.

In an affidavit, detectives stated that the suspect concealed a bow and arrows in a sack. When officers ordered him to leave, he allegedly charged at them and fired two arrows, one missed, while the other struck Constable Matanka in the chest, resulting in his death.

“Preliminary investigations revealed that at around 08:10 hours, the respondent, who was armed with a bow and arrows concealed in a sack, took cover behind a vehicle undergoing a security check-up, suddenly drew the bow and released an arrow, injuring Matanka on the left side of his chest and causing serious injuries,” Inspector Boya stated.

Matanka, 30, was rushed to Kenyatta National Hospital but later succumbed to his injuries. The slain officer was attached to the GSU’s Police G Company, which provides security at State House and government lodges across the country.

Before joining the National Police Service, Matanka had served in former President Uhuru Kenyatta’s Green Army, an initiative established to clean the Nairobi River and support waste management in the city.

Sources close to the investigation revealed that Matanka met Mr Musyimi during his time in the Green Army, when Mr Musyimi was working at State House. The two allegedly developed a close friendship, considered unusual given that Mr Musyimi was nearly twice Matanka’s age. The friendship is said to have softened security protocols. The killing occurred when the two sat in a security booth by the gate.

Prosecutors opposed the suspect’s release on bail, stating that he was a flight risk.

The judge scheduled a mention on February 9 to confirm compliance and proceed with plea-taking.
