For years, the biggest environmental court battles centred on highways, railways, ports and power plants. Judges used to be asked whether developers had consulted affected communities, produced credible environmental studies or obtained approvals resitquired by law.
Increasingly, however, another question has emerged inside the courtrooms: how much legal protection should be given to the landscapes that wild animals use to move between protected areas.
That question now sits at the heart of a sweeping constitutional petition filed in the Environment and Land Court in Nairobi, where regional lawyers and environmental organisations are challenging approvals granted for the Ritz-Carlton Maasai Mara Safari Camp and seeking orders that could reshape how tourism developments are approved inside protected ecosystems.
Conservation groups want the courts to recognise migration corridors as constitutionally protected landscapes rather than planning considerations.
The petition, filed by the East Africa Law Society, Natural Justice, JustAct and the Africa Centre for Peace and Human Rights, targets the Ritz-Carlton Maasai Mara Safari Camp, Sala's Camp and Elewana Sand River Masai Mara, while also seeking a court-supervised audit of all accommodation facilities operating within the national reserve's Low Use Zone and Mara River Ecological Zone.
But its ambition extends far beyond one lodge on the Sand River at the Kenya-Tanzania border, which is the primary crossing point for the wildlife migration.
The organisations ask the court to determine whether internationally recognised wildlife migration corridors deserve constitutional protection, and whether Kenya's obligations under environmental treaties are directly enforceable in domestic courts.
They also want the court to determine whether multinational hotel brands can bear responsibility for environmental harm arising from franchised operations.
The petitioners describe the dispute as "a pressing environmental concern with urgent constitutional, ecological, and transboundary dimensions" arising from the construction of the Ritz-Carlton camp within what they describe as a protected migratory corridor along the Sand River.
They argue the lodge was developed despite a moratorium contained in the Maasai Mara National Reserve Management Plan 2023-2032, which suspended new accommodation facilities after visitor numbers exceeded the reserve's ecological carrying capacity.
According to the petition, the camp occupies the reserve's Low Use Zone, where lodgings are prohibited, and lies adjacent to the Mara River Ecological Zone established primarily to protect riverine forests, rhino habitat and wildebeest crossing points.
The petition alleges that approvals granted by the Narok County government and the National Environment Management Authority (Nema) overlooked those restrictions, relied on an inadequate environmental impact assessment and failed to provide meaningful public participation.
It also challenges what the petition describes as a presidential exemption allowing the project to proceed despite the moratorium.
The new petition arrives after two earlier legal challenges, filed by conservationist Joel Meitamei Ole Dapash and the East Africa Tour Guide Drivers Association, against the Ritz-Carlton camp failed on procedural grounds.
Marriott, Lazizi Mara, Narok County, Nema and KWS have previously maintained that the development obtained all required approvals and complied with applicable environmental requirements.
The earlier legal challenges were struck out by Justice Lucy Gacheru after finding the petitioners had bypassed the National Environment Tribunal, while also accepting the developer's and regulators' position that the project had received necessary approvals, and did not lie within a gazetted wildlife migration corridor.
The case seeks to overcome those setbacks by introducing broader constitutional and international law issues, and scientific evidence that the organisations say has never been tested on its merits.
Yet the fresh litigation reflects a broader evolution in Kenyan environmental law, where disputes increasingly turn on scientific evidence, constitutional rights and ecosystem connectivity rather than solely on whether a developer obtained a licence.

The evolution of this kind of litigation has been gradual. Over the past 15 years, courts and tribunals have increasingly found themselves at the centre of disputes where development collides with wildlife conservation.
Litigation over the Mombasa-Nairobi standard gauge railway and other transport infrastructure through the Nairobi National Park ecosystem tested whether national projects could proceed without unduly fragmenting wildlife habitat.
Legal challenges surrounding the capital city’s Southern Bypass raised similar questions about balancing road construction with ecological protection.
The LAPSSET corridor connecting Lamu Port with South Sudan and Ethiopia generated environmental litigation over its potential effects on fragile ecosystems, biodiversity and wildlife habitats in northern Kenya.
Disputes over wind energy and other developments in Kajiado and the Amboseli landscape also highlighted growing concerns about animal dispersal areas.
The landmark Amu coal plant case, although not centred on migration corridors, established that environmental approvals would face rigorous judicial scrutiny over public participation, cumulative impacts and the adequacy of environmental impact assessments.
The fresh Maasai Mara petition now pushes that jurisprudence further by asking whether an internationally recognised wildlife migration corridor is itself entitled to constitutional protection.
A decade ago, environmental litigation was largely dominated by challenges to impact assessments.
Campaigners questioned whether regulators had properly evaluated pollution, biodiversity loss and community impacts before approving major projects.
One of the clearest examples came from Lamu in 2019, where the National Environment Tribunal cancelled the environmental licence for the proposed coal-fired power plant after finding significant deficiencies in public participation and shortcomings in the environmental assessment.
The dispute ultimately became a landmark illustration of how courts were prepared to interrogate not merely whether an environmental study existed, but whether it genuinely addressed ecological consequences of a project.
Around the same period, pressure mounted around Nairobi National Park as expanding transport infrastructure and urban development pushed closer to one of Africa's only protected wildlife areas bordering a capital city.
Parliamentary inquiries, conservation reports and litigation increasingly focused on wildlife dispersal areas and ecological connectivity rather than isolated protected parcels of land.
Mapping undertaken with government support identified wildlife corridors as critical ecological assets whose fragmentation threatened long-term conservation.
Those disputes gradually shifted the conversation. Rather than asking whether individual developments damaged wildlife habitat, courts increasingly encountered arguments that the survival of ecosystems depended on preserving movement between them. A protected national reserve may remain legally intact while becoming ecologically weaker if animals that depend upon seasonal movement can no longer reach breeding grounds, grazing areas or water sources.
According to the court filings, the organisations will rely on 26 years of GPS collar data from the University of Glasgow's Serengeti Biodiversity Programme, satellite imagery and ecological expert testimony to argue that the disputed developments sit within the core migration corridor used by approximately 1.36 million wildebeest moving annually between Tanzania's Serengeti National Park and Kenya's Maasai Mara National Reserve.
“The Serengeti-Mara wildebeest migration is recognised by the Guinness Book of Records as the world's greatest annual terrestrial wildlife migration involving approximately 1.36 million wildebeest, accompanied by hundreds of thousands of zebras and gazelles, traversing the Kenya-Tanzania border in a biologically determined circular route,” says GNS Advocates LLP representing the petitioners.
The petition claims the data demonstrate measurable changes in wildlife movement after construction began. It alleges that high-density crossings previously recorded along the Sand River have declined while use of areas south of the border has increased. Those assertions have not yet been tested in court.
The organisations argue that this scientific evidence transforms the dispute from an ordinary planning disagreement into a constitutional question.
They tell the court that "the public interest in granting this order is overwhelming," warning that permitting luxury developments inside primary migration corridors "would be catastrophic for every conservation area across Kenya and the East African Community."
Whether the court accepts those arguments may determine far more than the future of the luxury safari camps.
Judges are being asked to consider whether migration corridors are simply planning considerations to be balanced against economic development, or whether they have become constitutional environmental assets carrying legal protection in their own right.
The petition further asks judges to determine whether wildlife migration corridors mapped under the United Nations Convention on Migratory Species enjoy constitutional protection under Articles 42 and 69 of the law.
It also seeks declarations that Kenya's obligations under international environmental treaties are directly enforceable in domestic courts and that an environmental impact assessment based on inaccurate ecological information cannot satisfy constitutional standards.
It asks whether the law should recognise wildlife movement itself as an environmental resource deserving protection.
International hotel chains, infrastructure investors and multinational corporations increasingly operate through franchise or management agreements rather than direct ownership.
A ruling that constitutional environmental obligations extend beyond the project company could influence how global brands assess environmental and legal risks before entering sensitive ecosystems.
The petition also seeks to expand judicial oversight of environmental decision-making. The organisations ask the court to direct Narok County, Nema and KWS to audit every accommodation facility operating within the Maasai Mara's Low Use Zone and Mara River Ecological Zone.
They want the audit conducted under court supervision before agencies report back on developments occupying those protected landscapes.
Ultimately, they ask the court to order restoration of the environment and relocation of facilities found to have been unlawfully established in protected zones.
Earlier disputes frequently focused on stopping proposed projects before construction began. Increasingly, litigants are asking courts to determine what should happen after developments are completed and operational, particularly where ecological damage is alleged to be continuing.
The organisations tell the court that "the annual crossing season through the Sand River corridor commences in June of each year and continues through October," arguing that the Ritz-Carlton camp "has already disrupted one full migration season without any independent ecological oversight."
Whether those allegations are ultimately proved will depend on evidence tested during the proceedings.
For now, they remain claims advanced by the petitioners. The respondents have consistently taken a different position.
During earlier proceedings over the same development, Lazizi Mara maintained that its camp sits on lawfully leased land and received approvals from NEMA, Narok County Government and other relevant regulators.
The company argued that the project complies with applicable environmental and planning requirements and warned that continued litigation risks undermining jobs, community income and investor confidence in Kenya's tourism sector.
Government agencies have similarly maintained that the approvals complied with the applicable legal framework. Those competing narratives are likely to shape the next stage of the litigation.
Earlier landmark cases often turned on whether environmental impact assessments had been properly conducted or whether affected communities had been adequately consulted.
Courts increasingly insisted that environmental approvals must be supported by meaningful public participation and scientifically credible assessments before projects could proceed.
The organisations argue that satellite imagery, long-term GPS tracking data and ecological modelling should carry significant weight in determining whether developments are compatible with constitutionally protected environmental rights.
They also contend that international conservation obligations should become practical legal standards rather than aspirational policy commitments.
That progression mirrors broader developments in environmental law around the world, where scientific evidence increasingly shapes judicial decision-making in disputes involving biodiversity, climate change and ecosystem protection.
The Maasai Mara remains the country's flagship wildlife destination and a major contributor to tourism revenue. The same ecosystem also supports one of the world's largest remaining terrestrial wildlife migrations, an ecological process that crosses an international border and underpins both conservation and tourism.
Balancing those interests has never been straightforward as governments face pressure to expand high-end tourism, attract foreign investment and generate employment.
Conservation organisations warn that incremental development inside ecologically sensitive areas can gradually weaken the natural systems on which tourism itself depends.
That tension is not unique to the Maasai Mara because across Kenya, courts are increasingly finding themselves adjudicating disputes that governments, regulators and developers once resolved administratively.
Judges are being asked to weigh competing scientific evidence, interpret constitutional environmental rights and decide how economic development should coexist with biodiversity conservation.
