There is perhaps no political party in Kenya that understands the importance of securing a political brand better than the Orange Democratic Movement (ODM).
Its founders still recount how failure to promptly secure the party’s name nearly derailed the movement ahead of the 2007 General Election, forcing them into a scramble to recover the original ODM certificate after lawyer Mugambi Imanyara beat them to its registration.
Two decades later, history appears to be repeating itself, this time with one of ODM's own breakaway factions.
For months, Nairobi Senator Edwin Sifuna and his allies, including Siaya Governor James Orengo and Embakasi East MP Babu Owino, invested political capital in building the Linda Mwananchi movement into one of Kenya's fastest-growing opposition brands.
But while they mobilised supporters across the country, a parallel contest was quietly unfolding inside the Office of the Registrar of Political Parties.
By the time the movement sought to formalise its political identity, it had already stepped into a legal minefield of competing claims and fresh registrations, exposing how political momentum can sometimes outpace legal preparedness and how its leaders may have failed to heed one of ODM's own most enduring lessons.
Mr Sifuna’s team traversed the country holding rallies under a distinct political identity, adopted colours and messaging that increasingly departed from ODM's traditional branding, and cultivated a support base anchored on opposition to what they termed the party's accommodation of President William Ruto's broad-based government.

Yet while they invested heavily in building public recognition, they appear to have overlooked one of Kenya's oldest lessons in politics: a political slogan has little legal value unless it is secured first.
Confusion has erupted after the Office of the Registrar of Political Parties (ORPP) approved the registration of the Liberty National Democratic Alliance (LINDA) Party, reigniting a battle over the "Linda" political identity at the very moment Mr Sifuna's allies are trying to transform Linda Mwananchi into a formal political vehicle.
The controversy has exposed a familiar weakness in Kenya's political formations—leaders often spend months popularising slogans before taking the legal steps needed to secure them.
Ironically, the predicament facing Mr Sifuna's camp closely mirrors one of the defining moments in ODM's own history.
ODM’s old branding battle returns
In 2005, following the successful Orange campaign against the proposed constitution, opposition leaders assumed the Orange identity would naturally evolve into a political party.
Unknown to them, however, lawyer Mugambi Imanyara had already moved swiftly to reserve the Orange Democratic Movement (ODM) name.
When the late Raila Odinga, William Ruto, Musalia Mudavadi, Kalonzo Musyoka and their allies eventually sought registration, they discovered the name had already been taken.

Forced to improvise, they settled for ODM-Kenya, only for that party to later slip into the hands of Mr Musyoka's camp after temporary officials assumed legal control of the outfit.
Ultimately, the Raila-Ruto team had to negotiate with Mr Imanyara and acquire the original ODM certificate that he had secured immediately after the referendum.
The episode has become one of Kenya's classic examples of why political branding is as much a legal exercise as it is a political one.
Today, history appears to be repeating itself—except this time, those caught off guard are politicians who inherited ODM's legacy.
How Linda Mwananchi became a political force
Initially conceived as a counterweight to ODM Leader Dr Oburu Oginga's "Linda Ground" campaign, it gradually transformed into an organised political platform complete with national rallies, coordinated messaging and growing grassroots structures.

Supporters framed it as a campaign to reclaim accountability within ODM and restore the party's opposition credentials.
Its popularity grew rapidly, attracting governors, senators and MPs who had become increasingly uncomfortable with ODM's cooperation with Kenya Kwanza.
Yet while the movement expanded politically, no evidence emerged that its promoters had secured legal rights over the name.
Legal battle threatens Linda’s political identity
Mr Charles Wanyonyi became the first known applicant to seek reservation of the name "Linda Mwananchi Party of Kenya", filing his application with the Registrar in February.
His lawyers now argue that the Political Parties Act requires applications to be considered on a strict first-come-first-served basis.
The Registrar rejected the application—not because ownership belonged to Mr Sifuna's camp—but because the proposed name resembled existing reserved political identities and therefore offended provisions of the Political Parties Act.
That rejection, however, did not settle the matter.
Only after internal tensions within ODM deepened did leaders allied to Mr Sifuna formally seek reservation of the Linda Mwananchi name.
Their delegation held a meeting with Registrar of Political Parties John Cox Lorionokou early this week seeking a review of the earlier decision.
Mr Wanyonyi's lawyers accused the Registrar of reopening a concluded matter without notifying the original applicant, arguing that such a review would violate Article 47 of the Constitution and the Fair Administrative Action Act.
They insisted that politicians who entered the process later could not lawfully displace the rights of the first applicant.
Whether or not the Registrar ultimately changes his position, the episode illustrates that the battle has shifted from political mobilisation to procedural law.
Kenya's political history is littered with examples of individuals who recognised the commercial and strategic value of party names long before political heavyweights did.

By acting before the political class organised itself, he found himself holding one of the country's most valuable political assets.
The founders of ODM later acknowledged that recovering the certificate became essential to the party's survival ahead of the 2007 General Election.
That history explains why experienced politicians often move quickly to reserve names, logos and symbols long before publicly announcing new political formations.
“They acquire negotiating leverage during coalition talks, influence access to campaign financing and determine who legitimately flies the political flag,” he says.

Its organisers argued that months of rallies had made the slogan synonymous with their political identity and warned that allowing outsiders to register the name risked misleading supporters.
Lawyers representing the movement similarly maintained that registering the party under individuals unconnected to the campaign would create confusion and potentially expose supporters to fraud.
Politically, their argument carries weight.
Legally, however, branding alone may not establish ownership, adds Mr Omore.
He says that under the Political Parties Act, applications are assessed against statutory requirements rather than political popularity.
“Questions of similarity, public interest and compliance with constitutional provisions generally take precedence over claims that a slogan has become associated with particular politicians,” the advocate says.
The emergence of the Liberty National Democratic Alliance (LINDA) Party has complicated matters even further.
Although Mr Sifuna's allies insist the newly approved party has no relationship with their movement, the registration has effectively occupied the broader "Linda" political space.
Former Jubilee official Pauline Njoroge, now a member of Mr Sifuna’s camp however sees the government’s hand in their legal quagmire.
"This administration has failed to provide a convincing explanation for the registration of the so-called LINDA Party. If its official name is Liberty National Democratic Alliance, then its logical abbreviation should be 'LNDA', not 'LINDA'. Our Linda is not an acronym at all—it is a Kiswahili word that represents our movement," argues Ms Njoroge.

She argues that the ORPP should not use "flimsy excuses" to deny reservation of the Linda Mwananchi name, insisting the movement has every right to retain its political identity.
"Kenyans should not have their intelligence insulted. Linda Mwananchi is our movement, and we will secure our name. After all, the country has had parties with similar names, such as Ford Kenya and Ford Asili, as well as Kenya National Congress and Kenya African National Union. There is therefore no justification for denying us the reservation of our name," added Ms Njoroge.
But analysts say that even if Linda Mwananchi eventually secures approval, it may still have to navigate concerns over similarity between political identities.
“That is precisely the type of legal contest seasoned political strategists normally seek to avoid by acting early,” says Mr Geoffrey Mboya.
Sifuna camp faces a choice ahead of 2027
The dispute also raises broader questions about strategic planning within the Linda Mwananchi movement.
“Its leaders successfully built a recognisable national brand, mobilised crowds, generated media attention, established themselves as ODM's most visible reformist bloc, yet securing legal ownership of that identity appears to have come much later,” Mr Mboya adds.
Political observers often argue that movements intending to evolve into parties should quietly complete legal processes before unveiling nationwide mobilisation.
Doing it the other way around, they argue, exposes them to exactly the kind of disputes now unfolding.
During ODM's 20th anniversary celebrations in Mombasa last year, founding chairman Henry Kosgey publicly recounted how the Orange movement nearly collapsed after discovering that Mr Imanyara had already registered ODM, forcing the leadership into a desperate scramble that eventually required acquiring his certificate before the 2007 elections.
His recollection served as a reminder that political parties are born not only through rallies and speeches but also through timely legal preparation.
Yet two decades later, one of the party's most prominent breakaway factions appears to have underestimated precisely the same risk.
“If the office reverses its earlier rejection, it must explain why a proposal previously found inconsistent with the Political Parties Act has suddenly become acceptable,” argues Mr Wanyonyi’s advocates.
If it maintains the rejection, Mr Sifuna's camp may have to abandon a political identity into which it has already invested significant political capital or seek an alternative vehicle before the 2027 General Election.
“For the Linda Mwananchi movement, the contest is no longer simply about who coined the slogan or who attracted the biggest rallies, but about who moved first. And if history is any guide, Kenyan politics has consistently rewarded those who secure the paperwork before they secure the crowds,” Mr Omore says.
